What is the Madrid System?

The Madrid System is a convenient and cost-effective solution for registering and managing trademarks worldwide. Who can use the Madrid System?

You can use the Madrid System if you are a national of or have a domicile or business in any of the 129 countries covered by the Madrid System’s 113 members.

How much does an international trademark registration cost?

Fees include:
A basic fee (653 Swiss francs; or 903 Swiss francs for a mark in color) (Note! A 90% reduction applies if you are filing an application in the IP Office of a least-developed country); and

Additional fees depending on where you want to protect your mark, and how many classes of goods and services you want to cover.

To expand the geographical coverage of, or modify or renew your international registration you will have to pay additional fees.

Five Steps of filing intentional trademark application under Madrid System:

  1. Basic application\registration of trademark in the home country(office of origin).
  2. Submission of your trademark application in the office of origin. Your application should be based on your basic application\registration. You can not change your mark or class or goods/services but you can restrict class or goods\services.
  3. Formal examination of your trademark application by WIPO.

WIPO will check whether your trademark application complies with all formal requirementsm which includes:

  • sufficient contact details
  • designation of at least one Madrid System member
  • quality of images
  • payment of fees etc.
  1. Registration of your trademark in the International Register and publication of the same in the WIPO Gazette of International Marks. Upon registration, your trademark application will be forwarded to the designated countries.
  2. Substantive examination of your trademark application by national IP office of designated countries as if it was filed directly.

National Route will be more beneficial compare to Madrid Route under the following circumstances:

  • When you have different branding in different countries
  • When the proposed countries have strict/compled requirement as to specification of goods and services
  • When you have plan to transfer your trademark to non-madrid member countries
  • When you have risk central attack. Your trademark(say weaker trademark), which may not able to overcome objection to be raised by the IP office your home countries
